1. Definities
Opdrachtgever: De persoon of organisatie die de opdracht voor de diensten verstrekt.
Marc Driessen Media: Freelance fotograaf en videomaker, hierna te noemen als "Opdrachtnemer."
Diensten: Alle fotografie- en video werkzaamheden die onderwerp zijn van de opdracht.
2. Toepasselijkheid
Deze algemene voorwaarden zijn van toepassing op alle offertes, overeenkomsten en leveringen van diensten door of namens de Opdrachtnemer.
3. Aanbiedingen en Offertes
Alle offertes zijn vrijblijvend, tenzij anders is aangegeven. Wijzigingen in de oorspronkelijke opdracht door de Opdrachtgever zijn slechts geldig als deze schriftelijk zijn bevestigd door beide partijen.
4. Prijzen en Betaling
Tenzij anders overeengekomen, dienen alle facturen binnen 30 dagen na factuurdatum te worden betaald. Bij niet-tijdige betaling kan de Opdrachtnemer de werkzaamheden opschorten. Voor grotere opdrachten dient 50% van het totaalbedrag vooraf te worden betaald. De resterende 50% dient binnen 30 dagen na factuurdatum te worden betaald.
5. Uitvoering van de Overeenkomst
Opdrachtnemer zal de diensten naar beste vermogen en als zorgvuldig handelend beroepsbeoefenaar uitvoeren. Voor diensten waarbij weersomstandigheden een rol kunnen spelen, zoals buiten shoots, kunnen alternatieve data worden afgesproken.
6. Wijzigingen en Annulering
Wijzigingen door de Opdrachtgever na acceptatie van de offerte kunnen leiden tot aanpassing van de overeengekomen prijs en termijnen. Annuleringen door de Opdrachtgever dienen schriftelijk te gebeuren en kunnen kosten met zich meebrengen.
7. Aansprakelijkheid en Vrijwaring
De aansprakelijkheid van de Opdrachtnemer is beperkt tot het factuurbedrag. Voor indirecte schade, zoals gevolgschade, is de Opdrachtnemer niet aansprakelijk.
8. Intellectuele Eigendom
Tenzij schriftelijk anders is overeengekomen, blijven alle intellectuele-eigendomsrechten op de geleverde diensten bij de Opdrachtnemer.
9. Portfolio Gebruik
Tenzij anders schriftelijk overeengekomen, heeft Marc Driessen Media het recht om het materiaal te gebruiken voor portfolio-doeleinden, zowel online als offline.
10. Geheimhouding en Privacy
Beide partijen zijn verplicht tot geheimhouding van alle vertrouwelijke informatie. Daarnaast zal Opdrachtnemer zorgvuldig omgaan met persoonsgegevens in overeenstemming met de AVG.
11. Overmacht
In geval van overmacht, zoals maar niet beperkt tot natuurrampen en pandemieën, is Opdrachtnemer niet aansprakelijk voor het niet nakomen van verplichtingen.
12. Geschillen en Toepasselijk Recht
Op deze algemene voorwaarden is Nederlands recht van toepassing. Geschillen zullen zo veel mogelijk in onderling overleg worden opgelost, voordat een beroep op de rechter wordt gedaan.
1. Definitions

Marc Driessen Media: Freelance photographer and videomaker, hereinafter referred to as "Contractor."
Services: All photography and videography tasks that are subject to the assignment.
2. Applicability
These general terms and conditions apply to all offers, contracts, and deliveries of services by or on behalf of the Contractor.
3. Offers and Quotes
All quotes are non-binding unless otherwise stated. Amendments to the original assignment by the Client are valid only if confirmed in writing by both parties.
4. Prices and Payment
Unless otherwise agreed, all invoices must be paid within 30 days from the date of the invoice. In the event of late payment, the Contractor may suspend work. For larger assignments, 50% of the total amount must be paid in advance. The remaining 50% must be paid within 30 days from the date of the invoice.
5. Execution of the Agreement
The Contractor shall perform the services to the best of their ability and as a diligent professional. For services where weather conditions may play a role, such as outdoor shoots, alternative dates can be arranged.
6. Amendments and Cancellation
Changes by the Client after acceptance of the quote may lead to adjustments in the agreed price and timelines. Cancellations by the Client must be made in writing and may incur charges.
7. Liability and Indemnification
The liability of the Contractor is limited to the invoice amount. The Contractor is not liable for indirect damages, such as consequential damages.
8. Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights to the delivered services remain with the Contractor.
9. Portfolio Use
Unless otherwise agreed in writing, Marc Driessen Media reserves the right to use the material for portfolio purposes, both online and offline.
10. Confidentiality and Privacy
Both parties are obligated to maintain confidentiality of all confidential information. In addition, the Contractor will handle personal data in accordance with GDPR.
11. Force Majeure
In the event of force majeure, such as but not limited to natural disasters and pandemics, the Contractor is not liable for failure to fulfil obligations.
12. Disputes and Governing Law
These general terms and conditions are governed by Dutch law. Disputes will be resolved as much as possible by mutual agreement before resorting to legal action.

All content appearing on this website, including but not limited to photographs, films, and text, is the exclusive property of Marc Driessen and is protected under international copyright laws. All rights are reserved by Marc Driessen.

You are expressly prohibited from:
Reproducing, copying, editing, transmitting, uploading, or distributing the content in any manner or form without the prior written consent of Marc Driessen.
Commercial exploitation of any of the Content
Using the Content in any way that could harm the reputation of Marc Driessen or the depicted subjects. Using the Content in any way that violates any applicable local, national, or international law. 
Prior Written Consent

Legal Action
Failure to comply with these terms may result in legal action against the individual or entity engaged in prohibited use of the Content.
