Terms & Conditions
1. Definitions
Client: The individual or organisation commissioning the services.
Marc Driessen Films: Freelance filmmaker providing the services described in these Terms & Conditions.
Services: All filming, photography, editing, colour grading, drone operation, sound recording, post-production and related creative services provided by Marc Driessen Films.
2. Applicability
These Terms & Conditions apply to all quotations, agreements and services provided by or on behalf of Marc Driessen Films.
By accepting a quotation or commissioning services, the Client agrees to these Terms & Conditions unless otherwise agreed in writing.
3. Quotations and Agreements
All quotations are non-binding unless expressly stated otherwise.
An agreement becomes effective once the quotation has been accepted in writing by the Client.
Any changes or additions to the agreed assignment must be confirmed in writing and may result in adjustments to the agreed fee, planning and delivery schedule.
4. Prices and Payment
Unless otherwise agreed, invoices are payable within 30 days of the invoice date.
For larger assignments, Marc Driessen Films may require a 50% advance payment before work commences. The remaining balance is payable within 30 days of the final invoice.
If payment is not received within the agreed payment term, Marc Driessen Films reserves the right to suspend work until payment has been received. Statutory interest and reasonable collection costs may be charged in accordance with Dutch law.
5. Execution of the Agreement
Marc Driessen Films will perform the agreed services with due care, professionalism and to the highest professional standards.
Delivery dates are estimates unless expressly agreed otherwise in writing. A delay in delivery shall not entitle the Client to compensation or cancellation of the agreement.
Where weather conditions or other external circumstances affect production, such as outdoor filming, the parties will make reasonable efforts to arrange an alternative date.
The Client is responsible for obtaining any necessary permissions, permits, licences or approvals required for the execution of the assignment unless otherwise agreed.
6. Revisions
Unless otherwise agreed in writing, the quoted price includes one round of revisions following delivery.
Additional revisions or changes beyond the agreed scope will be charged at the applicable rate.
7. Cancellation and Rescheduling
Cancellation of an assignment must be made in writing.
If the Client cancels a confirmed assignment, the following cancellation fees may apply:
- More than 14 days before the scheduled production date: No cancellation fee, except for any costs already incurred on behalf of the Client.
- Between 7 and 14 days before the scheduled production date: 25% of the agreed fee.
- Between 48 hours and 7 days before the scheduled production date: 50% of the agreed fee.
- Less than 48 hours before the scheduled production date, or in the event of a no-show: 100% of the agreed fee.
Any third-party costs already incurred, such as equipment hire, studio rental, permits or other non-refundable expenses, will be charged to the Client in addition to the applicable cancellation fee.
If the assignment is postponed rather than cancelled, Marc Driessen Films will make reasonable efforts to accommodate a new production date, subject to availability. Any additional costs resulting from the rescheduling may be charged.
Where filming depends on suitable weather conditions, and adverse weather makes production impractical or unsafe, the parties will make reasonable efforts to reschedule the assignment without cancellation fees. Any additional costs resulting directly from the rescheduling will be discussed and agreed upon in advance.
8. Liability
The total liability of Marc Driessen Films arising from any agreement shall be limited to the amount invoiced for the relevant assignment, except where liability cannot legally be excluded under Dutch law.
Marc Driessen Films shall not be liable for indirect or consequential damages, including but not limited to loss of profits, business interruption, loss of data or missed commercial opportunities.
9. Intellectual Property
Unless otherwise agreed in writing, all copyrights and other intellectual property rights relating to the delivered work remain the exclusive property of Marc Driessen Films.
Upon full payment, the Client receives a non-exclusive licence to use the delivered material for the purposes agreed in the quotation or assignment.
The Client may not sell, sublicense, substantially modify or commercially exploit the material beyond the agreed use without prior written permission from Marc Driessen Films.
Raw footage, project files and editing files remain the property of Marc Driessen Films unless expressly agreed otherwise in writing.
10. Portfolio Use
Unless otherwise agreed in writing, Marc Driessen Films reserves the right to use completed work for portfolio purposes, including publication on its website and in promotional materials.
11. Confidentiality and Privacy
Both parties shall treat all confidential information obtained during the execution of the agreement as confidential and shall not disclose such information to third parties without prior consent.
Personal data will be processed in accordance with the General Data Protection Regulation (GDPR). Further information is available in the Privacy Policy published on this website.
12. File Storage
Marc Driessen Films will retain project files, including raw footage and editing project files, for a period of one (1) year following final delivery. After this period, files may be permanently deleted without prior notice. Long-term archiving is not included unless agreed separately in writing.
13. Force Majeure
Marc Driessen Films shall not be liable for any delay or failure to perform obligations resulting from circumstances beyond reasonable control, including but not limited to illness, accidents, equipment failure, government restrictions, natural disasters, pandemics, transport disruptions or other events constituting force majeure.
Where possible, both parties will make reasonable efforts to agree upon an alternative solution or production date.
14. Governing Law and Disputes
These Terms & Conditions are governed exclusively by the laws of the Netherlands.
The parties shall first endeavour to resolve any dispute through mutual consultation before submitting the matter to the competent Dutch court.

Algemene Voorwaarden
1. Definities
Opdrachtgever: De natuurlijke persoon of rechtspersoon die opdracht geeft tot het verrichten van diensten.
Marc Driessen Films: Freelance filmmaker die de in deze Algemene Voorwaarden omschreven diensten verleent.
Diensten: Alle werkzaamheden op het gebied van filmproductie, fotografie, montage, kleurcorrectie, drone-opnames, geluidsopnames, postproductie en aanverwante creatieve diensten die door Marc Driessen Films worden uitgevoerd.
2. Toepasselijkheid
Deze Algemene Voorwaarden zijn van toepassing op alle offertes, overeenkomsten en diensten die door of namens Marc Driessen Films worden aangeboden of uitgevoerd.
Door een offerte te accepteren of een opdracht te verstrekken, gaat de Opdrachtgever akkoord met deze Algemene Voorwaarden, tenzij schriftelijk anders is overeengekomen.
3. Offertes en Overeenkomsten
Alle offertes zijn vrijblijvend, tenzij uitdrukkelijk anders vermeld.
Een overeenkomst komt tot stand zodra de Opdrachtgever de offerte schriftelijk heeft geaccepteerd.
Wijzigingen of aanvullingen op de overeengekomen opdracht dienen schriftelijk te worden bevestigd en kunnen leiden tot aanpassing van de overeengekomen prijs, planning en oplevertermijn.
4. Prijzen en Betaling
Tenzij anders overeengekomen, dienen facturen binnen 30 dagen na factuurdatum te worden voldaan.
Bij grotere opdrachten kan Marc Driessen Films een aanbetaling van 50% verlangen voordat de werkzaamheden aanvangen. Het resterende bedrag dient binnen 30 dagen na de eindfactuur te worden betaald.
Indien betaling niet binnen de overeengekomen termijn plaatsvindt, behoudt Marc Driessen Films zich het recht voor de werkzaamheden op te schorten totdat de betaling is ontvangen. Wettelijke rente en redelijke incassokosten kunnen in rekening worden gebracht overeenkomstig de Nederlandse wet.
5. Uitvoering van de Overeenkomst
Marc Driessen Films zal de overeengekomen werkzaamheden zorgvuldig, professioneel en volgens de hoogste professionele standaarden uitvoeren.
Opgegeven oplevertermijnen zijn indicatief, tenzij schriftelijk anders is overeengekomen. Overschrijding van een oplevertermijn geeft de Opdrachtgever geen recht op schadevergoeding of ontbinding van de overeenkomst.
Wanneer weersomstandigheden of andere externe omstandigheden invloed hebben op de uitvoering van de productie, zoals bij buitenopnames, zullen beide partijen zich redelijkerwijs inspannen om een alternatieve opnamedatum af te spreken.
De Opdrachtgever is verantwoordelijk voor het verkrijgen van alle benodigde vergunningen, toestemmingen en overige goedkeuringen die noodzakelijk zijn voor de uitvoering van de opdracht, tenzij schriftelijk anders is overeengekomen.
6. Correctierondes
Tenzij schriftelijk anders is overeengekomen, is één correctieronde inbegrepen in de overeengekomen prijs.
Aanvullende correcties of wijzigingen buiten de afgesproken opdracht worden in rekening gebracht tegen het geldende tarief.
7. Annulering en Verplaatsing van de Opdracht
Annulering van een opdracht dient schriftelijk te gebeuren.
Bij annulering van een bevestigde opdracht kunnen de volgende annuleringskosten in rekening worden gebracht:
- Meer dan 14 dagen vóór de geplande opnamedatum: geen annuleringskosten, met uitzondering van reeds gemaakte kosten namens de Opdrachtgever.
- Tussen 7 en 14 dagen vóór de geplande opnamedatum: 25% van het overeengekomen bedrag.
- Tussen 48 uur en 7 dagen vóór de geplande opnamedatum: 50% van het overeengekomen bedrag.
- Minder dan 48 uur vóór de geplande opnamedatum of bij een no-show: 100% van het overeengekomen bedrag.
Eventuele reeds gemaakte kosten van derden, zoals apparatuurhuur, studiokosten, vergunningen of andere niet-restitueerbare kosten, worden aanvullend aan de Opdrachtgever doorberekend.
Wanneer een opdracht wordt verplaatst in plaats van geannuleerd, zal Marc Driessen Films zich redelijkerwijs inspannen om een nieuwe opnamedatum in te plannen, afhankelijk van de beschikbaarheid. Eventuele extra kosten als gevolg van de verplaatsing kunnen in rekening worden gebracht.
Indien de uitvoering van de opdracht afhankelijk is van geschikte weersomstandigheden en deze het filmen onmogelijk of onveilig maken, zullen beide partijen zich inspannen om de opdracht zonder annuleringskosten te verplaatsen. Eventuele extra kosten die direct voortvloeien uit de nieuwe planning worden vooraf besproken en overeengekomen.
8. Aansprakelijkheid
De totale aansprakelijkheid van Marc Driessen Films voortvloeiend uit een overeenkomst is beperkt tot het factuurbedrag van de betreffende opdracht, tenzij aansprakelijkheid op grond van dwingend recht niet kan worden uitgesloten.
Marc Driessen Films is niet aansprakelijk voor indirecte schade of gevolgschade, waaronder maar niet beperkt tot winstderving, bedrijfsschade, verlies van gegevens of gemiste commerciële kansen.
9. Intellectueel Eigendom
Tenzij schriftelijk anders is overeengekomen, blijven alle auteursrechten en overige intellectuele eigendomsrechten op het geleverde werk volledig eigendom van Marc Driessen Films.
Na volledige betaling ontvangt de Opdrachtgever een niet-exclusieve gebruikslicentie voor het gebruik van het geleverde materiaal overeenkomstig het in de offerte of opdracht overeengekomen doel.
Het is de Opdrachtgever niet toegestaan het geleverde materiaal zonder voorafgaande schriftelijke toestemming van Marc Driessen Films te verkopen, in sublicentie te geven, ingrijpend te wijzigen of commercieel te exploiteren buiten het overeengekomen gebruik.
Ruwe opnames (raw footage), projectbestanden en montagebestanden blijven eigendom van Marc Driessen Films, tenzij schriftelijk anders is overeengekomen.
10. Portfolio
Tenzij schriftelijk anders is overeengekomen, behoudt Marc Driessen Films zich het recht voor om voltooid werk te gebruiken voor portfolio-doeleinden, waaronder publicatie op de eigen website en in promotioneel materiaal.
11. Vertrouwelijkheid en Privacy
Beide partijen behandelen alle vertrouwelijke informatie die tijdens de uitvoering van de overeenkomst wordt verkregen als vertrouwelijk en verstrekken deze niet aan derden zonder voorafgaande toestemming.
Persoonsgegevens worden verwerkt overeenkomstig de Algemene Verordening Gegevensbescherming (AVG). Meer informatie is te vinden in het Privacybeleid op deze website.
12. Bewaartermijn van Bestanden
Marc Driessen Films bewaart projectbestanden, waaronder ruwe opnames (raw footage) en montagebestanden, gedurende een periode van één (1) jaar na de definitieve oplevering. Na deze periode kunnen bestanden zonder voorafgaande kennisgeving permanent worden verwijderd. Langdurige archivering is niet inbegrepen, tenzij hierover schriftelijk andere afspraken zijn gemaakt.
13. Overmacht
Marc Driessen Films is niet aansprakelijk voor enige vertraging of het niet kunnen nakomen van verplichtingen als gevolg van omstandigheden buiten haar redelijke invloedssfeer, waaronder maar niet beperkt tot ziekte, ongevallen, technische storingen, overheidsmaatregelen, natuurrampen, pandemieën, transportproblemen of andere vormen van overmacht.
Indien mogelijk zullen beide partijen zich inspannen om gezamenlijk tot een passende oplossing of een nieuwe productiedatum te komen.
14. Toepasselijk Recht en Geschillen
Op deze Algemene Voorwaarden is uitsluitend Nederlands recht van toepassing.
Partijen zullen zich inspannen om eventuele geschillen eerst in onderling overleg op te lossen alvorens deze voor te leggen aan de bevoegde Nederlandse rechter.
